Senate Can't Vote On $15 Minimum Wage, Parliamentarian Rules

Activists are likely to be disappointed that the Senate parliamentarian ruled against the inclusion of a $15 minimum wage in the giant COVID relief bill. But the provision's omission likely means the measure will gain more support in the Senate.

Senate Democrats will not be forced to confront an internal political battle over increasing the federal minimum wage to $15 following a decision by the primary keeper of Senate rules.

The Senate parliamentarian ruled that a plan to gradually increase the federal minimum wage to $15 an hour by 2025 does not fit the complicated rules that govern budget bills in the Senate. House Democrats included the measure in a $1.9 trillion coronavirus relief bill that is expected to be the first major legislative act for President Biden.

Senate Majority Leader Chuck Schumer, D-N.Y., said he is disappointed in the decision and pledged to pursue other legislation to increase the minimum wage.

"We are not going to give up the fight to raise the minimum wage to $15 to help millions of struggling American workers and their families," Schumer said in a statement. "The American people deserve it, and we are committed to making it a reality."

Sen. Lindsey Graham, R-S.C., the top Republican on the Senate Budget Committee, praised the ruling, saying it was the appropriate path to protect the rules of the Senate.

The decision is a disappointment for progressives but relieves immediate pressure on Democratic Party leaders who are attempting to rally support for the overall bill despite concerns from at least two Democrats who say $15 is too high.

In a statement, the White House said President Biden, who proposed the $15 minimum wage as part of his American Recue Plan, is "disappointed" but that he "urges Congress to move quickly to pass" the relief. It also said he will work with leaders in Congress to determine the "best path forward."

Sens. Joe Manchin, D-W.Va., and Kyrsten Sinema, D-Ariz., are the only Democrats who have publicly opposed the idea, but many others have been selectively silent on the issue.

Democrats were bracing for the measure to be removed from the bill, and the path to an increase is much more difficult in the Senate, where most legislation needs 60 votes to avoid a filibuster. Senate Republicans are almost uniformly opposed to the plan, and a stand-alone bill to increase the minimum wage, introduced by Senate Budget Committee Chairman Bernie Sanders, I-Vt., has 37 co-sponsors, meaning a number of Democrats may not back the idea.

In a statement, Sanders said that in the coming days he "will be working with my colleagues in the Senate to move forward with an amendment to take tax deductions away from large, profitable corporations that don't pay workers at least $15 an hour and to provide small businesses with the incentives they need to raise wages."

"That amendment must be included in this reconciliation bill," he continued.

No Republicans are expected to vote for the massive spending package, meaning there will need to be unanimous support among Democrats to advance Biden's first major legislative priority.

Senate Says No To $15 Minimum Wage For Now, But Democrats Vow To Push O

President Biden's push for a $15 federal minimum wage appears to be on hold for now.

As part of a marathon session of voting on amendments to Biden's $1.9 trillion coronavirus relief package, the Senate late Thursday approved by voice vote a measure prohibiting an increase of the federal minimum wage during the global pandemic.

"A $15 federal minimum wage would be devastating for our hardest-hit small businesses at a time when they can least afford it," said Sen. Joni Ernst, a Republican from Iowa, who brought up the amendment.

Sen. Bernie Sanders, I-Vt., vowed to push forward on a phased increase, saying he never intended to increase the federal minimum wage to $15 an hour during the pandemic. The federal minimum has been $7.25 since 2009, but dozens of states and cities have a higher minimum wage.

Earlier on Thursday, House Speaker Nancy Pelosi said that whatever happened with the stimulus package, Democrats would not abandon the cause. "It's not the last bill we'll pass," she said.

Even before Thursday night's vote, there were signs of trouble for Biden's $15-minimum-wage campaign promise. Among them, Sen. Joe Manchin, D-W.Va., has said he would not support an increase to $15 but would back something "responsible and reasonable."

Still, Biden's early effort to make good on his promise has buoyed proponents, unsettled opponents and stepped up the debate over who wins and who loses when salaries rise.

As economics professor David Neumark of the University of California, Irvine, notes in a new paper, economists hold a wide range of differing opinions on that debate, even when looking at the same set of studies.

One longstanding argument against raising the minimum wage is that it would force to employers to cut jobs. Neumark found most studies agree that higher minimum wages bring job losses, with stronger evidence for teens, young adults and less-educated workers.

A 2019 study from the Congressional Budget Office found that raising the federal minimum wage to $15 an hour by 2025 would boost earnings for at least 17 million people but could lead to 1.3 million job losses.

But others say the potential benefits — including reducing overall poverty — have been overlooked.

"I found somewhat smaller impact than [the CBO] did and even more promising impact of ... raising wages," says Arindrajit Dube, an economics professor at the University of Massachusetts, Amherst.

"At least prior to the pandemic, we saw employers continuing to hire and continuing to do well, and wages continuing to rise, including in low-wage sectors like restaurants," he says.

In states like California and Massachusetts where minimum wages have risen substantially over the past five years, Dube says employers have found ways of adjusting, including passing on costs to consumers.

"Prices definitely rise, but they rise [a] very small amount when it comes to the overall inflation," he says. "Minimum wage workers' earnings are a really small part of the overall economy, because they're the lowest-paid workers. So you're not going to really notice overall price increases even when minimum wage rises quite a bit."

"It leaves you in the tough place — to ask customers to pick up the bill. Or do I take the hit?" she says, noting that the pandemic has added additional financial stress.

"I have had to really take a look at our staff, and go, 'Do we have to bring someone down to part time?' and that's heartbreaking. I don't want to do that. ... we definitely used to have a much larger team when I first opened in 2014."

Dube notes that he and other proponents of raising the federal minimum wage to $15 an hour do not advocate doing so immediately. In Florida, where voters approved a $15 minimum wage through a ballot measure last fall, wages will not reach $15 until 2026.

"So thinking about where do we want to be four or five years from now — and do we want to have a $7.25 minimum wage? — I think is sort of the starting point," Dube says.

Fewer than 2% of hourly paid workers actually earn the federal minimum wage, according to the Labor Department. Twenty-nine states and the District of Columbia already have minimum wages higher than the federal minimum of $7.25. And 45 localities have adopted minimum wages above their states' minimum. Still, raising the federal minimum to $15 by 2025 would increase earnings for an estimated 32 million people, or 21% of the U.S. workforce, according to the Economic Policy Institute.

Notably, EPI says, the wage hike would boost income for people of color, who make up a disproportionate share of low-wage workers. Nearly one-third of African-American workers and one-quarter of Latino workers would see raises.

"The law that's being proposed today in terms of its impacts on workers — and which workers — has a lot of echoes with the expansion in minimum wage coverage in the 1960s," says Ellora Derenoncourt, an economic historian at the University of California, Berkeley, who has studied the role that federal minimum wage policy played in reducing racial wage disparities in the 1960s.

Among the demands at the 1963 March on Washington was an expansion of coverage of the Fair Labor Standards Act to include all areas of employment, including industries where Black workers were overrepresented.

"We estimate that about a fifth of the reduction in the racial earnings gap in the Civil Rights period, in the years after the Civil Rights Act, actually comes from expanded coverage of the minimum wage," she says.

Derenoncourt also points to another demand put forward at the March on Washington: a $2 national minimum wage — the equivalent of almost $17 today.

"The increase in the minimum wage [today] would disproportionately benefit Black workers," Derenoncourt says. "We think that that could reduce racial inequality today, which is still at very high levels."
