On Iran, the Least-Worst Option

The preliminary nuclear deal announced in Switzerland means that Obama may very well succeed in keeping his promise to Israel. Iran, it appears, will not gain possession of a nuclear weapon while he is president. If Iran adheres to the terms of the deal, as best as we understand those sketchy terms today, it will not have a nuclear weapon during the terms of the next one or two U.S. presidents. However, this deal, should it actually be ratified in June, formalizes Iran’s status as an eventual nuclear-threshold state by allowing it to maintain a vast nuclear infrastructure. This was not part of the international community’s original plan, and it is a cause for worry.

The best argument Obama can make for this deal is the argument he’s consistently made—that a deal is better than the alternatives. There is much apocalyptic talk emanating from Israel at the moment, and I understand it. The imbalance in the Iran-Israel relationship is not often understood, especially by cheerleaders for a deal. Iran seeks the physical annihilation of Israel. Israel seeks cordial relations with Iran. Of course Israel is worried that an anti-Semitic regime will be allowed to maintain a nuclear infrastructure.

But I hope Israelis listen to people such as the columnist Nahum Barnea, who wrote, following the announcement of the deal, “Obama presented the agreement as the lesser of two evils. The other options—striking at Iran’s nuclear facilities and thus starting a war, or continuing with sanctions and allowing Iran to get the bomb—would have led to a far more dangerous reality.”

War would not end the Iranian nuclear challenge. Israeli strikes, and certainly U.S. strikes, could destroy much of the physical infrastructure of the Iranian nuclear program, but cruise missiles cannot destroy knowledge, and I doubt they could destroy the will of the regime. Iran would rebuild those facilities, and would do so free from the burden of international sanctions, which would most likely crumble after such a preventative attack. Sanctions, too, were not bringing Iran to total capitulation....the Iranian regime was not going to capitulate in the face of a collapsing economy. It would have adapted.

Benjamin Netanyahu insists that opposing Thursday’s framework nuclear deal with Iran doesn’t mean he wants war. “There’s a third alternative,” the Israeli prime minister told CNN on Sunday, “and that is standing firm, ratcheting up the pressure until you get a better deal.”




There are three problems with this argument. The first is that even some of Netanyahu’s own ideological allies don’t buy it. Netanyahu and many Republican politicians—knowing that the American public doesn’t want war—insist that there’s a diplomatic alternative to the current deal. But over the years, key conservative foreign-policy experts, have said exactly the opposite. Eliot Cohen, a former Bush administration official who teaches at John Hopkins’ School of Advanced International Studies, has written that, “The choices are now what they ever were: an American or an Israeli strike, which would probably cause a substantial war, or living in a world with Iranian nuclear weapons, which may also result in war, perhaps nuclear, over a longer period of time. Understandably, the U.S. government has hoped for a middle course of sanctions, negotiations and bargaining that would remove the problem without the ugly consequences. This is self-delusion.” According to Max Boot of the Council on Foreign Relations, “The only credible option for significantly delaying the Iranian nuclear program would be a bombing campaign.” The Weekly Standard’s Bill Kristol has argued that, “It’s long since been time for the United States to speak to this regime in the language it understands—force. … We can strike at the Iranian Revolutionary Guard Corps (IRGC), and weaken them. And we can hit the regime’s nuclear weapons program, and set it back.” And over the last month alone, two other prominent hawks, John Bolton and Joshua Muravchik, have penned op-eds entitled, “To Stop Iran’s Bomb, Bomb Iran” and “War With Iran Is Probably Our Best Option.” Netanyahu may sincerely believe that there’s a preferable diplomatic alternative to last week’s deal. But it’s telling that for years now, many on his ideological side have disagreed.

First, of course, the argument ignores the essence of negotiation—that neither side gets everything it wants. Also, although it is true that sanctions are imposing real pain on the Iranian economy, there are many in Iran’s power elite, especially in the Revolutionary Guard, who profit from the country’s isolation and would welcome continuing sanctions. Others oppose a deal for ideological reasons. The balance in Iranian politics that brought negotiators into serious talks for the first time was long in coming and remains precarious. If the US were to reverse course, abandoning negotiations in hopes of a winner-take-all outcome, Iran would follow suit.

The second problem with Netanyahu’s argument is that it’s based on bizarre assumptions about Iranian politics. According to Netanyahu, if the United States walks away from the current deal, Iran’s desperation to end global sanctions will lead it to scrap its nuclear program almost entirely. But Iran’s nuclear program is decades old and enjoys broad public support. Even Mir-Hossein Mousavi, the leader of the reformist Green Movement, declared in 2009 that if elected, “we will not abandon the great achievements of Iranian scientists. I too will not suspend uranium enrichment.”



It’s true that one wing of the current Iranian regime, led by President Hassan Rouhani and Foreign Minister Mohammad Javad Zarif, will accept substantial limits on Iran’s nuclear program in return for the lifting of sanctions. But Rouhani’s hardline opponents, who benefit politically and economically from the sanctions, fiercely oppose such a deal. Netanyahu thinks a more aggressive American posture, coupled with a demand for near-complete Iranian capitulation, will make Tehran accept terms that today not even Iranian doves accept. To grasp how absurd that it is, just reverse the lens. How would more aggressive Iranian behavior, coupled with a demand for near-complete American capitulation, affect the debate in Washington? Would it turn Tom Cotton into Noam Chomsky? Of course not. It would empower those Americans who most oppose a deal already.

It’s the same in Iran. If the United States scuttles Thursday’s deal, Ali Vaez, senior Iran analyst at the International Crisis Group told me, Rouhani and Zarif will “be totally discredited, marginalized. That would be the end of Rouhani’s attempt at talks to resolve this peacefully.” Rand Corporation Iran expert Alireza Nader added that, “If everything collapses and Rouhani has nothing to show for his efforts, the balance may go toward conservatives and ultra-conservatives and they can make it hard for him to go back to table.”

Finally, there’s a third, less well-appreciated flaw in Netanyahu’s argument. He assumes that after walking away from the current deal, the United States can “ratchet up the pressure on Iran.” In fact, the pressure will likely go down.

Yes, Congress can pass additional sanctions. But more American sanctions alone won’t have much effect. After all, the United States began seriously sanctioning Iran in the mid-1990s. Yet for a decade and a half, those sanctions had no major impact on Iran’s nuclear program. That’s largely because foreign companies ignored American pleas to stop doing business with the Islamic Republic.

As Tyler Cullis of the National Iranian American Council explains, the shift came in 2010 when the UN Security Council passed resolutions essentially blessing America’s financial sanctions on Iran. Armed with this UN imprimatur, the Obama administration convinced Europe to stop doing business with Iranian banks and to stop importing Iranian oil. And while China and India didn’t cease Iranian oil imports altogether, they significantly reduced them.

Why did the world suddenly crack down on Iran? Partly, it’s because the United States threatened that companies doing business with Iran would lose access to the American market. But America had been leveling that threat since the mid-1990s, and until 2010, foreign governments had largely ignored the threat. In 1996, for instance, after Bill Clinton signed a law giving the United States the right to bar foreign companies that invested in Iran’s energy sector from doing business in the U.S., the European Union threatened to take the United States to the World Trade Organization, and Clinton backed down.

Things changed in 2010 because the Obama administration—aided by the antics of then-Iranian President Mahmoud Ahmadinejad—convinced European and Asian governments that the only way to get a diplomatic deal with Tehran was to apply economic pressure first. This global pressure has now isolated Iran from the world economy in a way that American pressure alone never could.




But if the United States walks away from a deal that European and Asian governments support, those governments will not indefinitely maintain a sanctions regime that lacks domestic political support and costs them money. Last year, a report by the European Council on Foreign Relations warned that “those [in the United States] blocking implementation of a final deal … could endanger the international consensus backing sanctions against Iran.” If Congress torpedoes a deal, the report predicted, Europe might react “by easing its unilateral oil embargo against Iran.” In addition, “China and Russia … may become more sympathetic towards Iran’s position and see an opportunity to further advance their own interests at the expense of the US.”

China, in particular, has a history of strong economic ties to Iran, a massive thirst for oil, and little interest in doing America’s bidding in the Middle East. If the United States walks away from a deal that Beijing has endorsed, it’s only a matter of time until China imports large quantities of Iranian crude. Chinese impatience is already starting to show. Beijing imported 30 percent more oil from Iran in 2014 than it had in 2013. As the International Crisis Group’s Ali Vaez observes, “The high-water mark of international sanctions is already behind us.”

Netanyahu thinks the United States can blow up the current nuclear negotiations and then “ratchet up the pressure” on Tehran. But if China and other nations respond by busting the international sanctions that have isolated Iran over the past few years, the pressure on Iran won’t go up. It will go down.

This doesn’t mean, as President Obama has suggested, that the only alternative to the current deal is war. But it does mean that all the other alternatives are bad.

If nuclear negotiations fail, Iran might still stop short of building a bomb. That way it could enjoy the deterrence that comes from “threshold” nuclear status without weaponizing, which might provoke its neighbors to build nukes themselves. It’s even possible that if the U.S. sabotages Thursday’s deal, a future U.S. president might strike another nuclear agreement with Tehran. But by that point, sanctions would likely have eroded and Iran’s nuclear program would be further along. Which means that such a deal, far from being tougher, would be a lot weaker than the current one.

The key flaw in Netanyahu’s critique of the Iran deal is his belief that America—having convinced the world to pressure Iran into accepting an agreement that enjoys global support—can now destroy that deal and expect the pressure to increase. It won’t. To the contrary, if America follows Netanyahu’s advice, Iran’s isolation will ease and America’s will grow. Perhaps it’s no surprise that a leader whose policies have so isolated his own country from the world is urging the United States down a similar path.

The argument for adding nonnuclear issues to the negotiations at this point—such as demanding that Iran must first agree to end support for terrorism—is equally untenable. The decision to limit the negotiations to Iran’s nuclear program was made, more than two years ago, for good reason. The number of grievances each side had against the other, and the decades-deep reservoir of distrust between them, meant that an all-encompassing agenda would reduce the already slim chances of success to near zero. Adding in the differing views of the P5+1 partners (China, France, Russia, the UK, the US, and Germany) only reinforces the conclusion. The goal posts cannot reasonably be moved now to include other aspects of Iranian policy, no matter how objectionable.

Obama argues strongly against adding policy conditions to the negotiations:
"The notion that we would condition Iran not getting nuclear weapons in a verifiable deal on Iran recognizing Israel is really akin to saying that we won't sign a deal unless the nature of the Iranian regime completely transforms," Obama said. "And that is, I think, a fundamental misjudgment. I want to return to this point: We want Iran not to have nuclear weapons precisely because we can't bank on the nature of the regime changing. That's exactly why we don't want to have nuclear weapons. If suddenly Iran transformed itself to Germany or Sweden or France then there would be a different set of conversations about their nuclear infrastructure."

Iran Deal: Don’t Pop The Champagne Yet.

Current and former U.S. intelligence officials and Iran watchers said they were “pleasantly surprised” by the deal, noting that more details were put on paper than they’d expected, and that they saw more concessions from Iran than they thought were possible given that the talks in recent days appeared headed toward a stalemate.

“I think that [the negotiators] were able to specify enough detail in this agreement to justify the effort to continue another three months and try to complete a comprehensive agreement,” Gary Samore, Obama’s former coordinator for arms control and weapons of mass destruction, told The Daily Beast.

Samore cautioned that many technical details remain to be worked out, including (crucially) what the mechanism will be for additional inspections and monitoring measures to ensure that Iran is living up to its end of the deal.

In Iran, there was dancing in the streets as people heard the arrangement would end all sanctions related to the country’s nuclear program.

It will be a miracle, in fact, if the deal outlined today can be wrapped up by the end of June, the deadline that’s been announced. Not only are the technical details to be resolved enormous and complicated, attacks on the whole process are likely to be relentless.

On one side are those in Washington who think no deal with Iran is satisfactory unless it results in complete capitulation by Tehran (and, they hope, the fall of the regime there). On the other are those in Iran who believe the best long-term guarantee for their security is the threat they will present as a “nuclear threshold state,” able to build atomic weapons on short notice, even if they choose not to do so.

The most critical question is not whether Iran can be trusted. Its history of nuclear deceit shows that is a dubious proposition, even if, for the record, Supreme Leader Ali Khamenei has issued a fatwa against building nuclear weapons. The critical question is whether the agreements being hammered out now will allow the inspectors of the International Atomic Energy Agency (IAEA) to discover any Iranian attempts to build a bomb in time to stop it.

In a briefing with reporters, senior administration officials insisted that inspectors would be allowed full coverage of the “supply chain” that Iran could use to build a weapon, and that they’d be able to uncover any covert activity. But one senior official acknowledged that Iranian negotiators still have to sell the deal back in Tehran, just as U.S. officials will face a skeptical Congress when they return to Washington.

“If Iran cheats, the world will know it,” Obama declared. “If we see something suspicious, we will inspect it. Iran’s past efforts to weaponize its program will be addressed. With this deal, Iran will face more inspections than any other country in the world.”

But he added: “Iran is not going to simply dismantle its program because we demand it to do so. That’s not how the world works, and that’s not what history shows us.” Iranian Foreign Minister Javad Zarif, for his part, said that while Iran will abide by the deal, “our facilities will continue.”

The rest of the current understanding is essentially about scaling back Iran’s production of nuclear fuel so that it cannot “break out”—that is, renege on its treaty obligations, oust inspectors, and build a nuclear bomb—in less than a year. As things stand now, without the deal in place, Obama said, “estimates indicated that Iran is only two or three months away from potentially acquiring the raw materials that could be used for a single nuclear bomb.” By comparison, a year is a better deal, but it’s still not a great deal.

Still, Samore said there were two notable “big wins” for the United States and its partners in the talks: The facility at Fordow will be “neutralized” for the next 15 years, and a facility that had been under construction at Arak will effectively be put out of the nuclear weapons-making business all together.




So, here’s the good news from the point of view of the United States and the five other countries—France, Great Britain, Germany, Russia and China—that participated in the negotiations:

• Iran has agreed to reduce by about two-thirds the number of centrifuges it has installed to enrich uranium, and not to enrich above the level of 3.67 percent for the next 15 years. To be useful in a bomb, the enrichment level has to be closer to 85 percent. Everything else will be put in storage and locked up by the IAEA, and Iran won’t build any new facilities for the purpose of enriching uranium for 15 years.

• The deal blocks another pathway to the Bomb—plutonium from Iran’s heavy water reactor at Arak. The core of that facility is going to be replaced so that no weapons grade plutonium can be produced. Additionally, no new heavy water reactor will be built for 15 years.


• To the extent that uranium enrichment continues, it is supposed to be conducted at only one facility, Natanz, which was kept secret until 2002 but is now the main enrichment plant. At the moment Iran has about 19,000 operational centrifuges for enrichment. For the next 10 years it will be able to use 5,060 of the oldest ones.

But the deal concerning another facility at Fordow, which is buried deep inside a mountain and theoretically invulnerable to attack from the air, is more problematic. Iran has agreed not to enrich uranium or have any fissile material there for 15 years. Instead it is supposed to be a “nuclear, physics, technology, research center,” according to the White House.

Critics of the deal already say the administration should have demanded that Fordow be shut down completely. The idea that a facility hardened against bunker buster bombs is just a research center strikes them as, to say the least, implausible.


The other area where it is essential but difficult to hold Iran accountable is on the question of what are called the PMDs, or the possible military dimensions, of its programs. For much of the last decade the IAEA has been trying to get Iran to explain intelligence that suggested it had a hidden weapons program, and its response has been to insist the intelligence was fabricated. Critics of the Iran negotiations are concerned that the administration will allow sanctions relief for Iran to begin before Tehran has offered a satisfactory explanation.

So, now that the Obama administration has managed to come to a political framework, attention turns to Congress, which is scheduled to consider legislation requiring additional congressional input into the deal.

“There is concern among some Democrats that the administration will sell a bad deal as passable, just for the sake of having a deal,” a senior Democratic aide told The Daily Beast.





Sen. Bob Corker, (R., Tenn.) [above], chairman of the Senate Foreign Relations Committee says the Foreign Relations Committee will vote on April 14, just after lawmakers return from an Easter recess, on the Corker-Menendez bill, a piece of legislation that would force a congressional review of any Iranian nuclear deal. The bill already has nine Democratic cosponsors, and the presumed support of all 54 Republican senators, putting it [four short] of a veto-proof majority. He said Thursday he expects a strong vote in favor of the measure. 


The White House has threatened to veto bills aimed at giving Congress an up-or-down vote on the final deal, as well as legislation that would impose additional sanctions on Iran.


But Menendez, a Democratic senator from New Jersey, has come under immense scrutiny because of his recent indictment on federal corruption charges. After they were filed against him this week, he stepped down as the top Democrat on the Senate Foreign Relations Committee, limiting his influence over the course of the legislation.
